Speaking outside the New South Wales Court of Criminal Appeal in Sydney on Thursday, she said prosecutors had \u201ccherry-picked\u201d entries in her diary to secure the 2003 conviction that found her guilty of killing her children.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">\u201cThey took my words out of context and turned them against me,\u201d she <a href=\"https:\/\/www.theguardian.com\/australia-news\/2023\/dec\/14\/kathleen-folbiggs-convictions-for-killing-her-four-children-quashed-by-nsw-court\" target=\"_blank\" rel=\"noopener\">told local reporters<\/a>.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p><span class=\"wpds-c-sFUaP wpds-c-sFUaP-jtHNGr-variant-interstitial wpds-c-sFUaP-iPJLV-css hide-for-print\"><a data-qa=\"interstitial-link\" data-testid=\"interstitial-link\" href=\"https:\/\/www.washingtonpost.com\/world\/2021\/05\/06\/australian-mother-murder-genetics\/?itid=lk_interstitial_manual_8\">An Australian mom was convicted of killing her 4 babies. Scientists say she\u2019s innocent.<\/a><\/span><\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">The diary entries were central to the prosecution\u2019s case, in a trial that was based largely on circumstantial evidence and the argument that four deaths within the same family could not have happened by chance.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">\u201cI knew I was short-tempered and cruel sometimes to her and she left. With a bit of help,\u201d she wrote in one diary entry about her daughter, Sarah, that drew scrutiny during the trial.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">The jury concluded that she had smothered the children, who were found, one after the other, lifeless in their cribs between 1989 and 1999: Caleb at 19 days, Patrick at eight months, Sarah at 10 months and Laura at 18 months. <\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">Folbigg was sentenced to 40 years in prison for murder and manslaughter, a sentence that was  reduced to a minimum of 25 years on appeal.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">In a <a href=\"https:\/\/www.abc.net.au\/news\/2018-08-13\/kathleen-folbigg-speaks-for-first-time-about-infants-death\/9906008?nw=0\" target=\"_blank\" rel=\"noopener\">2018 documentary<\/a>, she said the diary entries were written \u201cfrom a point of me always blaming myself\u201d \u2014 a trait <a href=\"https:\/\/www.smh.com.au\/national\/nsw\/folbigg-diaries-do-not-contain-true-expressions-of-guilt-inquiry-told-20230222-p5cmgc.html\" target=\"_blank\" rel=\"noopener\">experts say<\/a> is common in bereaved parents.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">\u201cI took so much of the responsibility, because that\u2019s, as mothers, what you do,\u201d Folbigg said in the documentary.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<div data-qa=\"article-video\" data-testid=\"article-video\" class=\"\">\n<div>\n<figure class=\"mr-auto-ns ml-auto-ns hide-for-print ml-neg-gutter mr-neg-gutter mb-md\"><figcaption>\n<p>Kathleen Folbigg, an Australian woman who served twenty years behind bars for killing her four children, was pardoned June 5 after new evidence emerged. (Video: Reuters)<\/p>\n<\/figcaption><\/figure>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">Doubts about her conviction grew in recent years as new science emerged.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">In 2021, dozens of scientists \u2014 including two Nobel laureates \u2014 <a href=\"https:\/\/www.science.org.au\/files\/userfiles\/events\/news\/documents\/petition-to-governor-of-nsw-for-pardon-of-kathleen-folbigg-05-03-21.pdf\" target=\"_blank\" rel=\"noopener\">petitioned the state governor<\/a> to request that Folbigg be pardoned and released. They argued that there was \u201csignificant positive evidence of natural causes of death\u201d after finding rare genetic mutations in the DNA of Folbigg and her daughters as well as variants in her sons\u2019 DNA that have been connected to deaths in young children.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">In November, the final report of an inquiry into the case found there was an <a href=\"https:\/\/www.theguardian.com\/australia-news\/2023\/nov\/08\/kathleen-folbigg-conviction-child-killing-potentially-overturned-evidence\" target=\"_blank\" rel=\"noopener\">\u201cidentifiable cause\u201d<\/a> for three of the children\u2019s deaths<b> <\/b>and that Folbigg\u2019s relationship with her children did not support the case that she killed them.<\/p>\n<\/div>\n<div class=\"article-body\" data-qa=\"article-body\">\n<p data-testid=\"drop-cap-letter\" data-el=\"text\" class=\"wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overrideStyles font-copy\" dir=\"null\">The overturning of Folbigg\u2019s convictions creates a path for her to seek compensation over her wrongful imprisonment.
